Welcome to VoteFest ("we", "our", "the Platform"). By accessing or using the VoteFest platform, you agree to be bound by these Terms & Conditions. Please read them carefully.
1. Acceptance of Terms
By registering an account or participating in any competition on VoteFest, you confirm that you have read, understood, and agree to these Terms & Conditions, our Privacy Policy, and all applicable laws of the Federal Republic of Nigeria.
2. Eligibility
- You must be at least 18 years of age to create an organiser account.
- Business accounts must be registered legal entities under Nigerian law (CAC registration required).
- VoteFest reserves the right to refuse or terminate any account at its sole discretion.
3. Account Registration & Activation
All newly registered organiser accounts default to pending status and must be activated by VoteFest administrators before competitions can be created. You will receive an email confirmation upon approval. VoteFest reserves the right to decline activation without providing a reason.
4. Competition Management
- Organisers are solely responsible for the content of their competitions, including contestant information and promotional materials.
- Competition content must not violate any Nigerian law, infringe on third-party intellectual property, or contain defamatory, obscene, or misleading content.
- VoteFest reserves the right to suspend or remove any competition that violates these terms.
- Organisers must ensure that contestants have provided consent to participate and have their information published on the Platform.
5. Voting & Payments
- All votes are purchased through secure payment gateways (Paystack, Cashonrails). Votes are credited only after payment is successfully verified.
- All prices are displayed in Nigerian Naira (NGN). Transactions are non-refundable unless there is a verified payment error.
- VoteFest employs mathematical validation and idempotency checks to ensure vote integrity. Duplicate payments or manipulated transaction amounts will be rejected.
- VoteFest does not guarantee uninterrupted access to payment gateways during periods of high traffic or maintenance.
6. Revenue Share & Disbursements
Revenue generated from vote purchases is split between the organiser and VoteFest according to the agreed-upon percentage set at the time of competition creation. Default splits are 70% organiser / 30% VoteFest. Disbursements are processed manually upon request and subject to a processing period of 3–5 business days.
7. Prohibited Activities
- Attempting to manipulate, reverse-engineer, or interfere with the voting system.
- Creating fake contestant profiles or fraudulent competitions.
- Using automated bots or scripts to cast votes.
- Any activity intended to circumvent VoteFest's security or payment validation mechanisms.
8. Limitation of Liability
VoteFest is provided "as is" without any warranties, express or implied. We shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Platform, including payment gateway outages, data loss, or competition interruptions.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State.
